OREGON SCRAP TIRE BRIEFING SHEET

STATE REGULATIONS
Legislation passed in 1987, Oregon Administration Rules set up a self-funded comprehensive program for waste tires including:

o regulation of storage and landfill of waste tires;
o chipping requirement for landfilling tires effective July 1, 1989;
o $1/tire disposal tax on the sale of new tires, used to clean up tire piles and to promote the use of waste tires by subsidizing markets for waste tires or chips;
o transporters of scrap tires must be licensed with the ODEQ, except generators hauling their own scrap tires;
o retail tire vendors with more than 1,500 scrap tires on site must obtain a permit from the ODEQ;

In January 1990, Department of Environmental Quality established a demonstration program allowing a higher subsidy ($0.01/LB is the established subsidy) for uses of waste tire which do not yet have an established market in Oregon:

The waste tire fee and subsidy ended on June 30, 1993, but the administrative rules pertaining to scrap tires are still in effect. Regional solid waste management offices are currently responsible for managing their scrap tire programs.

The funds would be used for personnel and activities associated with implementation of the Tire Recycling Act and would be granted to local governments for handling scrap tires and tire dump sites.

MAJOR MARKETS
Ashgrove Cement is using TDF. The DOT is conducting a research project to monitor heat fluctuation in a road embankment. The RMA has contributed to this project. Ground rubber is being used by two companies and there is some use of TDF in cement kilns, but many tires are landfilled.
