NEW YORK SCRAP TIRE BRIEFING SHEET
STATE REGULATIONS
In 1993, The NY State Department of Environmental Conservation revised Part
360-13, regulations for scrap tires. Part 360 regulations pertain to the requirements
for permits to construct and operate a scrap tire facility. Chapter 226, Section
27-0303 of the Environmental Conservation Law designates commercial scrap tires
as regulated waste.
Currently, under Part 360 regulations:
· transporters of scrap tires must be registered with the NYSDEC;
· scarp tire storage facilities storing more than 1,000 scrap tires must
have a permit; and
· retail tire vendors, retreaders, manufacturers of tire-derived products
or users of TDF must register with the NYSDEC and whole tires are banned from
landfills.
In 2003, the state passed a sweeping bill designed to address the scrap tire piles in the state and to also create market opportunities. A $2.50 fee is now placed on new car tires, new replacement tires, truck tires, and motorcycle tires. The fee is expected to raise nearly $60 million annually, with the state receiving $40 million, which will go to the general fund. In fiscal year 2004-2005, the governor proposed a budget of $18 million be earmarked for scrap tire activities.
MAJOR MARKETS
NYSDEC has given a Beneficial Use Determination to the use of processed
tires in civil engineering applications and as a supplemental fuel. NuCorp Steel
is using tires as a charge material.
