KANSAS SCRAP TIRE BRIEFING SHEET
STATE REGULATIONS
The Kansas waste tire program was established in 1990. In 2003 the legislature
(H.B. 2247) amended the waste tire statutes to include an expanded definition
of the beneficial use of waste tires. The program also:
· Provides for the disposal of cut tires in a landfill;
· Allows whole tires to be used as part of a proven and approved leachate
collection system;
· Allows cut tire chips to be used as daily cover material in landfills;
and
· Sets a $0.25/tire excise tax on the retail sale of new tires.
Regulations were effective July 1, 1992 (amended in 1997 and 2002) for waste tire processing facilities, collectors and collection centers requiring:
· Zoning and site plans;
· A management/operation plan for the site containing information on
the numbers of tires to be processed, type of processing to be used, a contingency
plan for fire or other emergencies, proof of ownership of site, a closure plan,
pile size limitations and site operation standards; and
· Waste tire collectors are required to have a permit and provide financial
assurance.
MAJOR MARKETS
One cement kiln uses whole tires as supplemental fuel, and there is a ground
rubber producer operating in state. Most of the tires in western Kansas go to
monofills.
