ILLINOIS SCRAP TIRE BRIEFING SHEET
STATE REGULATIONS
HB 1085 (PA 86-452) (1989) amended the Environmental Protection Act to create
the Used Tire Management program which includes provisions for:
· Cleanup of tire accumulations;
· Development of markets for tire-based products;
· Regulations to control mosquito infestations in tire accumulations;
· Financial assistance to units of local government for these activities;
· Establishes the Used Tire Management Fund effective January 1, 1990;
and
· Funding through a vehicle title transfer fee.
SB 989 (PA 87-727) (1991) further amended EPA to establish new $1 per tire fee for program, requires dealers accept scrap tires, requires development of abatement plan, prioritizes fund expenditures, requires pilot program and investigation of alternative tire uses.
· HB 1159 (PA 87-476 (1991) requires state retread tire procurement.
· SB 1768 (PA 87-1250) (1992) clarifies application of fee to various
tire types.
· SB 1724 (PA 88-0690) regulates landfills accepting and shredding tires.
· SB 629 (PA89-0200) limits storage sites to 1300 used tires, 1300 carcasses
and 130 recyclable tires.
Final rules for licensing of waste tire transporters and waste tire storage requirements were effective 1-1-92. Sites with more than 5000 tires are required to have financial assurance to cover the cost of site cleanup. In 2003, the legislature increased the state tire fee to $2.50 per tire, paid at point of purchase. A portion of the fee now goes toward the state's West Nile Virus efforts.
MAJOR MARKETS
One major electric generating facility uses TDF as supplemental fuel. Four
industrial facilities and two cement kilns also use TDF. Tests conducted at
three other facilities. Ground rubber producers are also active, and the state
uses scrap rubber in civil engineering applications.
