DELAWARE SCRAP TIRE BRIEFING SHEET

STATE REGULATIONS
Delaware has a law (§ 6040 Requirement for scrap tire piles; enforcement) regarding storage and maintenance of existing tire piles. During the 2006 session of the General Assembly, HB 455 established Delaware’s first comprehensive scrap tire management program. Amendments to Title 7 §6040 requires the Secretary of the Department of Natural Resources and Environmental Control (DNREC) promulgate regulations to establish standards for the management and abatement of scrap tires. Title 7 §6041 of the Delaware Code was added which creates the Scrap Tire Management Fund within the State Treasury.  The legislation requires a comprehensive inventory and registry of scrap tire piles in Delaware, as well as the establishment of a program for abatement by DNREC.  HB 455 amended Title 30 §2905 to require a levy of a $2 per tire fee at the point of retail.  By January 1, 2009, DNREC shall submit a scrap tire clean up progress report to the General Assembly and Governor to include recommendations for extension, modification, or termination of the Scrap Tire Management Fund.

MAJOR MARKETS
One facility produces ground rubber and landscape material from tires. One facility is producing CEM (Civil Engineering Material).
